Terms of service.

These terms govern your use of rosemarkotic.com, its free resources, and coaching services provided by Vila Markotić d.o.o. By using the site or any of our services you agree to them. They do not override your statutory rights as an EU consumer.

1. Who provides the service

All services are provided by Vila Markotić d.o.o., OIB 75035836266, registered in Croatia (EU). Contact: hello@rosemarkotic.com. Full company details on the imprint page.

2. What we provide

We provide coaching and educational services — skills-based non-clinical work focused on anxiety management, emotion regulation, and adjustment to life transitions. We do not provide psychotherapy, counseling, medical care, diagnosis, or treatment. See our disclaimer for the full scope statement.

3. Eligibility

Coaching services are offered only to clients physically located in jurisdictions where Rose Markotic does not hold a clinical license — i.e., everywhere except California, Connecticut, Maine, Rhode Island, and Vermont. Clients in those US states are served by Rose’s separate licensed therapy practice at getbetterthoughts.com.

You must be 18 or older to purchase any service. By purchasing you confirm you are.

4. Payments

Payments are processed through Stripe. Posted prices are final — Vila Markotić d.o.o. is not registered for VAT and operates under the Croatian small-business exemption (Article 90, Croatian VAT Act), so no VAT is charged or shown on invoices. Stripe emails your payment receipt at the time of purchase; your Croatian invoice (račun) is issued separately by Vila Markotić d.o.o. and can be requested at any time from hello@rosemarkotic.com.

Payment plans (Reset: 2 monthly installments; Steady, Transform: 2 or 3): via Stripe Subscriptions. Every payment plan is a fixed number of monthly payments for a fixed posted total— the stated term. It ends automatically after the final payment: it does not renew, does not continue, and converts into nothing. Failed installment payments trigger an automatic email with a Stripe Customer Portal link to update your card. Three failed retries cancel the subscription; we’ll then contact you to resolve manually.

5. Withdrawal / refunds (EU consumers)

Under the EU Consumer Rights Directive (2011/83/EU), you have a 14-day withdrawal right for distance contracts. How it applies here:

• Coaching packages (services): 14-day withdrawal applies, running from the day you purchase. There’s no waiting period — book your first session whenever suits you, including inside those 14 days. If you withdraw within the 14 days you get a full refund, even if we’ve already had a session; we don’t charge for sessions delivered during the withdrawal period. You’ll never be asked to waive or shorten that right in exchange for starting sooner.
• To withdraw: use the cancellation page (two clicks, no login, immediate written confirmation), email hello@rosemarkotic.com with your purchase reference, or use the model withdrawal form available on request.

6. Rescheduling + missed sessions

More than 24 hours notice: free reschedule. Less than 24 hours: session counts as used unless there’s a genuine emergency. Sessions are time reserved for you; ability to reschedule depends on notice.

Two related cases. If you arrive 15 minutes or more late, the session is treated as cancelled and counts as used unless Rose agrees to reschedule it — she isn’t required to stay in the video room past the first 15 minutes. If you don’t attend at all and give no notice (no-show), the session counts as used. It runs the other way too: if Rose has to cancel a session, it’s rescheduled at no cost to you and does not count as used.

7. Package cancellation

You can cancel any active coaching package or payment plan at any time, free of charge, without giving a reason. A public cancellation page exists for exactly this: rosemarkotic.com/cancel — no login, two steps (your details, then one confirmation), and an immediate written confirmation by email carrying your statement and the date and time it was submitted. Emailing hello@rosemarkotic.com from the address on your booking works equally.

Cancellation takes effect at the end of the current billing period: any remaining scheduled payments stop, and sessions you’ve paid for but not used are refunded proportionally (Article 14(3)); Rose may apply a more generous refund, never a less generous one. Within the first 14 days of purchase, §5 gives you a full refund instead — including if a session has already happened. Rose confirms the effective date and the exact refund in writing within 24–48 business hours.

8. Confidentiality

Session content is confidential. We do not share session notes or your data with third parties for marketing purposes.

One thing to be clear about, because it differs from therapy: confidentiality in coaching is an ethical and contractual commitment, not a legal privilege. Coaching communications are not covered by therapist–patient privilege and may be discoverable in legal proceedings. Consult your own attorney before treating them as privileged.

Circumstances in which Rose may disclose: an imminent risk of serious harm to you or someone else; information suggesting ongoing abuse or neglect of a minor, an elderly person, or a dependent adult; a valid court order, subpoena, or other legal compulsion; consultation with her own attorneys, accountants, or business advisors, who are bound by their own confidentiality obligations; and the service providers needed to run the practice (scheduling, payments, video), under data-handling agreements. 9. Intellectual property

All materials provided through coaching (worksheets, written skills guides) and the free downloadable resources (including the Starter Guide PDF and the email series) remain the intellectual property of Vila Markotić d.o.o. You may use them personally; you may not redistribute, resell, or share access with others.

10. Limitation of liability

Coaching outcomes depend on your active participation. We make no guarantee of specific outcomes. To the maximum extent permitted by Croatian and EU law, our liability is limited to the amount you paid for the specific service.

11. Governing law + disputes

These terms are governed by Croatian law. EU consumer protection law is preserved and prevails where applicable. For consumer disputes you may use the EU Online Dispute Resolution platform. For privacy / data complaints, see our privacy policy for the AZOP route.

12. Changes

When these terms change materially, we’ll post the new version with an updated date and email anyone with an active service contract. Prior versions are version-controlled and available on request.
